FREEDOM OF EXPRESSION ITS ESSENCE, SCOPE, AND LIMITS

15 Mart 2024

Course Objectives:

The main purpose of this course is to introduce the students to theories of freedom of expression and its contemporary social and legal approaches. The aim is to let students develop a general understanding of “time-place-manner” variables and the ever changing, dynamic concept of this doctrine. Through pre-class article and case-law assignments, the course will enhance the students’ ability to carry out academic readings. Furthermore, during their time in the class, the students will get a chance to contribute to the theoretical and on-the-field discussions, thereby develop a competence of critical thinking and discussion within the scope of freedom of expression.

Course Content:

The essence, scope and limits of freedom of expression will be assessed through theoretical readings and case-law arising from on-the-field practice. The course will not be limited to a certain jurisdiction. Thereby, in addition to the local regulations, the teachings will rely on Article 10 of the European Convention on Human Rights and the 1st Amendment of the US Constitution. The students will be presented various topics of discussion during the term such as “hate speech”, “artistic expression”, “political expression”, “sexual expression”, “right to assembly”, “freedom of press” and “displays of freedom of expression around the campus”. In certain days, experts on the subject will also be invited to provide a diverse perspective to the way the classes are held.
